but seriously, it was about time that this disparity got fixed.  We here at Too Old are not pro crack,  but at least make the sentencing fair between two similar (if not equal) drugs. Although after watching this video, maybe we should make crack harder to get, or raise the punishment for having it.   Ignore the singing in the beginning, but the rest of the video is hilarious…

WASHINGTON — The House of Representatives passed a historic bill Wednesday that narrows sentencing disparities between crack and powder cocaine convictions, which civil rights and civil liberties experts say contributed to the disproportionate imprisonment of African-Americans in recent decades.

Now, I want to clear something up here.  the people getting arrested are crackheads, and/or crack dealers.  Let’s not make it seem like they were caught up in a police sting through entrapment.  The one thing to remember is that they would have been in jail for dealing powder cocaine as well.  So, the numbers would have been similar, minus the people who would not have gotten involved in the coke game due to finances and connections.  It’s not like with coke they give you a free pass or anything…

The Senate passed its version of the bill in March. President Barack Obama, who during the 2008 presidential campaign said the current legal disparity “cannot be justified and should be eliminated,” is expected to sign the legislation.

By voice vote, the House altered a law implemented in 1986 during the early phase of the crack cocaine epidemic. It required anyone convicted of possession of 5 grams of crack to be sentenced to at least five years in prison.

Many lawmakers and organizations such as the NAACP and the American Civil Liberties Union complained for nearly a quarter-century that the law was unfair because someone convicted of crack possession got the same mandatory sentence as someone convicted of possessing 100 times that amount of powder cocaine, a drug more popular among whites.

Then keep your crack in powder form, until it is time to smoke up!.  Or, just don’t do crack. Because we all know crack is whack!

A 2009 report by the Sentencing Project, a liberal advocacy group, found that drug use rates were similar among racial and ethnic groups, but that sentencing among the groups for cocaine violations was vastly different, in large part because of the disparity between sentences for crack and powder cocaine.

In 2006, 81.8 percent of crack cocaine defendants were black, 8.8 percent were white and 8.4 percent were Hispanic, according the Sentencing Project report. For the same year, 57.5 percent of powder cocaine defendants were Hispanic, 27 percent were African-American and 14.7 were percent white.

“African American drug defendants have a 20 percent greater chance of being sentenced to prison than white drug defendants,” the Sentencing Project report said. “Between 1994 and 2003, the average time served by African Americans for drug offenses increased by 62 percent, compared to an increase of 17 percent for white drug offenders.”

The House bill raises the five-year mandatory minimum sentencing trigger for crack possession from five grams to 28 grams and eliminates mandatory minimum sentencing for simple possession of crack. Possession of 500 grams of powder cocaine carries a mandatory minimum five years in prison under the bill.

“In passing the Fair Sentencing Act today, the House sent a bill to President Obama that is a step forward in addressing the fairness of our sentencing laws,” said House Speaker Nancy Pelosi, D-Calif. “This legislation reduces the disparity between sentences for crack and powder cocaine – a step long overdue.”

Civil rights groups applauded the House vote and urged Obama to sign the bill quickly.

“Because of the mandatory minimum jail sentence for those convicted of possession of 5 grams of crack cocaine or more, people of color are being put in prisons at much higher rates than their Caucasian counterparts, and the judges have no discretion to mitigate the sentence for first-time or nonviolent offenders or special circumstances,” NAACP President Benjamin Jealous said. “This legislation is just the first step in eliminating disparities in sentencing, and we will continue to push for the elimination of this racially discriminatory sentencing disparity.”

How about we push to get people off crack?  I know the law had a racial bias to it.  But, let’s not celebrate like this is Brown vs. Board of Education or anything.  The specter of drugs is something that the communities need to work on.  This might be a first step, but keeping the kids off crack might be something to work on as well.

A Facebook feud between two women who claimed to love the same prison inmate led to a high-speed chase and a crash that critically injured one of the rivals, killed her friend and left the second rival facing murder charges.

Torrie Emery was arraigned Friday in Pontiac’s 50th District Court on multiple felonies, as friends of the dead woman were holding a car wash to pay for her funeral.

“It’s unbelievable,” said Pontiac police Chief Valard S. Gross told The Associated Press as he described the escalating dispute that ended with Wednesday’s deadly crash. “It’s just crazy.”

FACEBOOK and Twitter beef is not cute.  It solves nothing and makes you look like a fool for putting your business out there for all to see.

According to Gross, Emery, 23, and Danielle Booth, 20, had been feuding for some time, leading to an earlier police complaint. According to Emery’s family, the dispute was over a 23-year-old man now serving time in a Michigan prison.

On Wednesday, Emery was driving when she saw Booth in the passenger seat of a car driven by Alesha Abernathy and started chasing her, Gross said. Emery had her 3-year-old daughter in the car with her.

How are you going to chase someone and you have your three year old daughter in the car with you?  Plus, how are you fighting over some scrub in prison, not jail, but prison?

Police Det. Paul McDougal, who was in an unmarked squad car, saw both vehicles rush by at speeds approaching 100 mph, Gross said. Before McDougal could reach them — and while a panicked Booth was on the phone with a police dispatcher — Abernathy ran a red light and plowed into a dump truck, knocking it onto its side but not injuring the truck’s driver.

The crash killed Abernathy and critically injured Booth, who was in the intensive care unit Friday at POH Regional Medical Center in Pontiac. Emery and her daughter weren’t hurt.

“How can you get that angry or that jealous, really, that you jeopardize the life of your 3-year-old?” Gross asked. “One person’s stupidity, and look at the repercussions. It’s just a ripple effect.”

Emery appeared on video at her arraignment Friday on charges of second-degree murder, assault with intent to do great bodily harm and child abuse. She indicated she would look for a lawyer.

Judge Preston Thomas ordered her jailed without bond and set her preliminary examination for next Thursday.

“We apologize to the family about what happened,” Emery’s aunt, Tamika White, said after the hearing. “This Facebook stuff is just a mess. They’re going on Facebook about a guy that neither one have — that’s in the penitentiary.”

“My sister didn’t mean to kill anybody,” said Traynea Emery, 19.

But, why is your sister and your niece so stupid?  What was she going to do when she got up to them?  Fight her?  Shout at her?  Those are all adult things to do. Across town in the parking lot of Pete’s Coney Island restaurant, a group of Abernathy’s friends were holding a car wash to raise money for the funeral they said Abernathy’s family couldn’t afford.

“She was the center of attention,” said Brittany Carriti, 22, of Pontiac, a former classmate from Manley Alternative High School in Waterford. She and her friends had raised several hundred dollars by midday.

Abernathy was “always the one for whom the party started,” said another ex-classmate, Chandra Tiernan, 23, of Waterford.

While Abernathy knew about the dispute between Booth and Emery, she wasn’t involved in it, Tiernan said.

“She died over someone else’s problem,” Tiernan said.

Hollywood socialite Kim Kardashian, daughter of late O.J. Simpson attorney Robert Kardashian, is caught up in a tricky love triangle with actor/rapper Nick Cannon and R&B crooner, Ray J — younger brother to singer Brandy. People make fun of me when I defend Mike Tyson about his rape charge or when I defended MJ about the various molestation charges.  I also was one who made jokes about it.  “Who would be so stupid to send their kids to spend the night with MJ?” I would ask.  Or, I would kid and say that for one night in the house of horrors, you can become a millionaire if you stay the whole time. While this sounds like it was written recently, it was written in the context of the MJ molestation trial that cost him in excess of 20 million dollars.

As the dust settles on one of the nation’s worst episodes of media excess, one thing is clear: The American public has never heard a defense of Michael Jackson. Until now.

It is, of course, impossible to prove a negative — that is, prove that something didn’t happen. But it is possible to take an in-depth look at the people who made the allegations against Jackson and thus gain insight into their character and motives. What emerges from such an examination, based on court documents, business records and scores of interviews, is a persuasive argument that Jackson molested no one and that he himself may have been the victim of a well-conceived plan to extract money from him.

This was one who took the joke too far and actually cashed in.  This is not like R Kelly and his trials.  There was not video that showed the act.  But, because this nigga can sing and is making songs for the current generation, we just give him a pass.  Plus, because it was a man and a younger girl, we are not offended.  Our sensibilities are offended when we think that it’s a homosexual relationship.

Counterpunch.org, in a story written by Ishmael Reed lays out the devious plan that everyone was in on, EXCEPT MJ!

Fisher claimed that the first case arose from the ambitions of the thirteen-year-old accuser’s stepfather,  Evan Chandler,  who exploited Jackson’s friendship with his son.  At one point,  he asked Jackson to build him a house.   Fisher said that the child denied being abused by Jackson until he was administered the drug sodium amytal,  which is known to induce false memory.  Chandler refused to be interviewed for the article and refused to appear on the Today Show, where Fisher repeated her charges before a nationwide audience.  She said that the whole scheme was concocted by the child’s stepfather to destroy the superstar.

Mary Fisher wrote the 1994 GQ article (that is being referenced above) about the molestation case that should have illuminated our view of Michael.  But, we are as a society, seduced by the salacious details of the crime to only look for guilt, not innocence.

Jackson’s personal eccentricities — from his attempts to remake his face through plastic surgery to his preference for the company of children — have been widely reported. And while it may be unusual for a 35-year-old man to have sleepovers with a 13-year-old child, the boy’s mother and others close to Jackson never thought it odd. Jackson’s behavior is better understood once it’s put in the context of his own childhood.
“Contrary to what you might think, Michael’s life hasn’t been a walk in the park,” one of his attorneys says. Jackson’s childhood essentially stopped — and his unorthodox life began — when he was 5 years old and living in Gary, Indiana. Michael spent his youth in rehearsal studios, on stages performing before millions of strangers and sleeping in an endless string of hotel rooms. Except for his eight brothers and sisters, Jackson was surrounded by adults who pushed him relentlessly, particularly his father, Joe Jackson — a strict, unaffectionate man who reportedly beat his children.

Now what about the second molestation case?  You know, the one where the jury found him NOT GUILTY?  People love to gloss over that little fact.  Again, we have to blame MJ somewhat.  He could have avoided a lot of the scrutiny with not doing the TV show following the trial.  But, look at his childhood.  That explains some of his behavior.

Jackson’s early experiences translated into a kind of arrested development, many say, and he became a child in a man’s body. “He never had a childhood,” says Bert Fields, a former attorney of Jackson’s. “He is having one now. His buddies are 12-year-old kids. They have pillow fights and food fights.” Jackson’s interest in children also translated into humanitarian efforts. Over the years, he has given millions to causes benefiting children, including his own Heal The World Foundation.
But there is another context — the one having to do with the times in which we live — in which most observers would evaluate Jackson’s behavior. “Given the current confusion and hysteria over child sexual abuse,” says Dr. Phillip Resnick, a noted Cleveland psychiatrist, “any physical or nurturing contact with a child may be seen as suspicious, and the adult could well be accused of sexual misconduct.”

Reed gives more information.  Instead of people joking about the crime that never happened, what about these pieces of information about the mother who lead the charge?

Jackson’s Attorney,  Tom Mesereau Jr.  got the teenage boy to admit that he lied under oath during the J. C. Penny case. USA Today reported on March 1,  2005,  that the mother used the boy as a prop to get money from Mike Tyson,  Adam Sandler,  Jim Carrey,  Jay Leno and others,  “even though insurance was paying his bills. ” Linda Deutsch,  one of the last of hard-nosed shoe leather journalists, reporting for the Associated Press on March of 2005.  said that Mesereau got the 15 year old to admit that he’d told Jeffrey Alpert,  a school official that “nothing happened “ between Jackson and him.

Did you really forget that the second trial, the mother had to admit that she was bilking all these other actors?  MJ, because of his generosity and his ignorance, got caught up in the trap…

Connie Keenan,  editor of Mid Valley News,  wrote of a hoax that the boy’s mother perpetrated on that newspaper.  She made a pitch that her son needed medical care and that she had no financial means to provide it.  During the first week of the newspaper’s appeal,  the mother received $965 in donations. It turned out that the boy was being treated at Kaiser Permanente in Los Angeles with no cost to the family. Connie Keenan concluded that “ My gut level,  she’s a shark.  She was after money.  My readers were used.  My staff was used.  It’s sickening. ”

But, people still get away with calling MJ a child molester.  The proof of the negative is impossible, but we have just let that charge stick to MJ without a shred of credible evidence…  Now, we can say that the high tech media lynching of MJ worked.  Enough people pimped the horse until it collapsed under the mounting weight of pressure.  The guy was only 50, yet, he was 112 pounds and 5 foot 10.  The Sun reveals how bad it got before his demise.

THE horrifying state of pop superstar Michael Jackson in his final days can be revealed by The Sun today.

Harrowing leaked autopsy details show the singer was a virtual skeleton — barely eating and with only pills in his stomach at the time he died.

His hips, thighs and shoulders were riddled with needle wounds — believed to be the result of injections of narcotic painkillers, given three times a day for years.

The examination showed the 5ft 10in star — once famed for his on-stage athleticism — had:

PLUNGED to a “severely emaciated” 8st 1oz. It is understood anorexic Jackson had been eating just one meagre meal a day.

Pathologists found his stomach empty aside from partially-dissolved pills he took before the painkiller injection which stopped his heart. Samples were sent for toxicology tests.

The Daily Mail begins to explain where MJ started to unravel.  The first case with Jordan (the son) and Evan (the Dad) Chandler threw MJ into a pit of despair.  It was so bad, that recently, MJ thought he was going to die and predicted his demise!

To understand why a singer of Jackson’s fragility would even think about traveling to London, we need to go back to June 13, 2005, when my involvement in his story began.

As a breaking news alert flashed on CNN announcing that the jury had reached a verdict in Jackson’s trial for allegedly molesting 13-year-old Gavin Arvizo at his Neverland Ranch in California, I knew that history had been made but that Michael Jackson had been broken – irrevocably so, as it proved.

Nor was it the first time that Michael had been accused of impropriety with young boys. Little more than a decade earlier, another 13-year-old, Jordan Chandler, made similar accusations in a case that was eventually settled before trial – but not before the damage had been done to Jackson’s reputation.

This goes back to your word and your bond.  Once you have lost it, no amount of money really can restore the harm done.  Now, the first case, Evan Chandler has allegedly (since this is not reported in the mainstream yet) has apologized and claimed that it was a plot of his father.  Even without that (since you can’t really verify something like that, the facts stack up to show that there is reason to doubt the story or at least reasons to not prosecute MJ in the public eye…Ian Halperin in the Daily Mail continues to lay out the case for MJ’s innocence

I had started my investigation convinced that Jackson was guilty. By the end, I no longer believed that.

I could not find a single shred of evidence suggesting that Jackson had molested a child. But I found significant evidence demonstrating that most, if not all, of his accusers lacked credibility and were motivated primarily by money.

Jackson also deserved much of the blame, of course. Continuing to share a bed with children even after the suspicions surfaced bordered on criminal stupidity.

While stupidity should be a crime, it isn’t.  MJ made horrible choices and surrounded himself with the wrong people.  That is life..it shouldn’t come with the scarlet letter of child molester.

He was also playing a truly dangerous game. It is clear to me that Michael was homosexual and that his taste was for young men, albeit not as young as Jordan Chandler or Gavin Arvizo.

In the course of my investigations, I spoke to two of his gay lovers, one a Hollywood waiter, the other an aspiring actor. The waiter had remained friends, perhaps more, with the singer until his death last week. He had served Jackson at a restaurant, Jackson made his interest plain and the two slept together the following night. According to the waiter, Jackson fell in love.

The actor, who has been given solid but uninspiring film parts, saw Jackson in the middle of 2007. He told me they had spent nearly every night together during their affair – an easy claim to make, you might think. But this lover produced corroboration in the form of photographs of the two of them together, and a witness.

Other witnesses speak of strings of young men visiting his house at all hours, even in the period of his decline. Some stayed overnight.

When Jackson lived in Las Vegas, one of his closest aides told how he would sneak off to a ‘grungy, rat-infested’ motel – often dressed as a woman to disguise his identity – to meet a male construction worker he had fallen in love with.

Jackson was acquitted in the Arvizo case, dramatically so, but the effect on his mental state was ruinous. Sources close to him suggest he was close to complete nervous breakdown.

The face that they found in the initial autopsy that all that was in MJ’s stomach was some undissolved pills shows the depths of the charges.  They couldn’t let the golden goose die.  They pumped him with pills to get him ready for the shows at the O2 Arena

‘Collapse might be overstating it,’ said the aide. ‘He needed medical attention and couldn’t go on. I’m not sure what caused it.’

Meanwhile, everybody around him noticed that Jackson had lost an astonishing amount of weight in recent months. His medical team even believed he was anorexic.

‘He goes days at a time hardly eating a thing and at one point his doctor was asking people if he had been throwing up after meals,’ one staff member told me in May.

‘He suspected bulimia but when we said he hardly eats any meals, the doc thought it was probably anorexia. He seemed alarmed and at one point said, ‘People die from that all the time. You’ve got to get him to eat.’’

Indeed, one known consequence of anorexia is cardiac arrest.

Fame must be one of those things that once you have it, you constantly crave it, like getting upgraded to first class accommodations.  He is still a big enough star to help force a deal. This is a deal that I can get behind for both teams, for different reasons. The Los Angeles Times is reporting what seems to be a done deal now…

The package the Suns would take back, according to Yahoo Sports’ Adrian Wojnarowski, is almost comical: Ben Wallace, who’s retiring and may accept a buyout; Sasha Pavlovic, whose salary is only partially guaranteed, and the 46th pick in today’s draft.

Shaq gets to upstage the entire NBA draft!  We don’t look at the draft as the Blake Griffin show, now the discussion has to be about Shaq and LBJ.  But, Shaq is the master of this type of self promotion…remember this?  (BTW I thought it was smooth…)

Here is the reason why I love it for the Cavs.  It shows LBJ that you were serious about getting him some more help.  What you gave up was not in the core rotation, so that is undisturbed.  The matchups still remain the same and this team won 66 games last year.  The teams that you have to watch out for still remain the same in Boston and Orlando.

Boston right now is hard to predict, because it sounds like they are about to undergo massive upheaval.

• The Rajon Rondo trade talk is still alive despite Danny Ainge‘s attempts at spin control. In speaking to the media Tuesday, Ainge was pretty adamant that if the Celtics trade Rondo, it will be to make their team better and not because of any problems with Rondo.

I’m not sure I totally buy that. Rondo was the best player for the Celtics in the playoffs, a triple-double machine and the bridge between their present and their future. How would trading Rondo away make the Celtics better?

I’m more persuaded by what several league sources told me about Doc Rivers‘ relationship with Rondo. They say Rivers has told them Rondo is “impossible to coach” and “stubborn.” The worry is that if the Celtics give him a big contract extension next year, he’ll be even more unmanageable in the future. So the Celtics are trying to trade him now, while his trade value is high, to avoid a very difficult decision a year from now.

So, you are a triple double machine AND the team is taking offers for your services?  That reinforces that you are a piece of meat…unless you are KG or Paul Pierce.  Rondo, hopefully you are going to come back humble and hard working.  But your reputation preceeds you.  That is why my dad was a big believer (actually had to take the time to email him and say what up…) in saying that your word is the most important thing that you posess.  Here is what Bill Burt posits about Rondo

For that reason, the Celtics are not the team that you attempt to build your team to beat, you clearly have to beat the Magic to contend for the Crown.  With Shaq, you can have an effective counter to Dwight Howard.

The other thing is that you preserve your other talented center, Big Z.  Now, he can be regulated to only playing about 20-25 minutes.  This allows Cleveland to be more flexible.  With Shaq, they have a tremendous low post presence.  You can pound the ball down low, trolling for easy shots and silly fouls on Howard.  While this is not the best strategy late in the game if you are behind, it can be an effective way to foul out Howard and get fouls on people coming over to double team.  That killed the Magic against the Lakers.

The second look that it provides is allowing the Cavs to have the Eastern Euro look, without having to actually have greasy Europeans on your team.

Now, the Cavs can have a lineup that can spread the floor and allow LBJ to be the facilitator.  The Cavs do some standing around with LBJ, watching him work.  If you can space the floor with some shooters and make it suicide for a team to double, that might be the impetus to get LBJ and the Cavs into the NBA finals.  ESPN gives another reason to like the deal…

The Cavaliers also were in talks with New Orleans about obtaining Tyson Chandler. If they had not made the trade for O’Neal, they would have traded for Chandler, according to a source.

The Cavs believed O’Neal was the better option because he has just one year left on his contract, and will not eat up cap space that will enable them to pursue players such as Chris Bosh in next summer’s star-studded free-agent class.

It’s all about flexibility and preserving options to keep LBJ at home. Plus, Chandler doesn’t have enough bump in the trunk to deal with Howard.

I like this for the Suns as well.  Shaq dominated the ball while he was in Phoenix.  When he touches the ball, it slowed down the “beautiful game” style that Steve Nash and Leandro Barbosa like to play, with the influenced D’Antoni/Nolan Richardson 4ominutes of hell/7 seconds or less type of play.  Both styles are not going to be enough to get the Suns past the Lakers.  The question is will that style get them past San Antonio, Dallas, Denver, Houston, Utah  and New Orleans.  There is obvious a lot of talent in the West.

Losing Shaq comes with some financial and emotional rewards with Phoenix.  First, they do not have to trade Amare.  This gives them some money to play around with.  It also keeps him happy.  I don’t think that Amare enjoyed the second fiddle role with Shaq in tow.  The financial rewards are explained in the ESPN article.

For the Suns, the O’Neal trade is a straight salary dump. Pavlovic’s $5 million contract next season is only partially guaranteed, for the amount of $1.5 million.

Factor in the disparities in the contracts among Wallace, Pavlovic and O’Neal, and the team will save $4.5 million next season.

However, factor in the savings the Suns will reap on the luxury tax, and it will be closer to $10 million in savings. That would be amplified if Wallace decides to retire and the Suns buy him out of his contract for less than the $14 million he’s owed next season.

I think that I am finally tired of hearing about David Letterman and Sarah Palin.  There are some quick housekeeping things to get out of the way right now, before we go any further on this topic.

1) Apologies.  How does someone know intent? How do you measure it?  Well, according to our favorite kooks on the blog, they have a device that measures whether your apology is sincere or not.  According to them, the apology is not sincere.

See, that is what you get when you make an apology that you didn’t need to make.  It was and still is a joke.  It was not in the best taste, but political figures are always up for lambasting.  The “Off-Limits” quote that Sarah and the others who feel outrage at this joke fees the need to throw around was directed AT THE OTHER CANDIDATES, not the media, and CERTAINLY NOT COMEDIANS.  That is the price you pay to be in the media spotlight.  Good thing that most of the haters feel this isn’t an apology, so we give him a pass.

2) Willow/Bristol Palin and “Rape” joke.  If you had not seen the Top 10 show (and I find that funny that so many people who express outrage are the same people who are claiming that they never watch him, or that they stopped decades ago, since he stopped being funny.  Really? Then who is watching him?  I mean he is finalizing another large contract extension and clearly, they wouldn’t sign him if nobody is watching?) then you would have thought that Letterman said that a group of baseball players should hold her down and forcibly rape her.

Here is a section of the Chicago Tribune that is asking for an apology.  Note that they state what Letterman said…

Until he does, the Alaska governor and her husband, Todd, have parental rights, even a duty, to press Letterman on the main point: that his jokes Tuesday night about the Palins’ visit to New York and Yankee Stadium — “There was one awkward moment during the seventh-inning stretch; her daughter was knocked up by [Yankee player] Alex Rodriguez” and “The hardest part of her trip was keeping [former New York Gov.] Eliot Spitzer away from her daughter” — were in terrible taste. (emphasis mine to highlight the joke(s) told)

So, the first part of the outrage is that he made a joke about AROD and one of the Palin daughters having ARODS baby.  I think that I missed the rape part of the joke right there.  See, that is a joke… Seriously, where can we insinuate that David Letterman is suggesting that AROD rape her daughter?  Wait for it… I dont think that you can.  Here is what the offended will say about it

First, before answering that, IF he is talking about Bristol, then case closed, you have no right to be offended or outraged, as she already has carnal knowledge, and like Levi stated, they sometimes didn’t practice safe sex and they had a kid.  She is 18, and that is an adult in every state.

That is getting knocked up.  Consensual sex without practicing safe sex, or the Ronin pull-out, can lead to having a child.  How can you get mad at that?  Where is the rape?  Where is the joke about rape?  That only leaves Willow as the possible “victim” of the “verbal rape” perpetrated by Dave Letterman.

So, let’s assume you don’t believe his statements about the joke.

Letterman, on Wednesday’s show, stepped up to the edge of an apology but did not get there. He defended himself by saying that he was joking about 18-year-old Bristol Palin, mother of a child out of wedlock, not 14-year-old Willow, the daughter who accompanied Sarah and Todd Palin to New York.

But he acknowledged that “I can’t really defend the joke. I agree: unpleasant, ugly.” And: “Do I regret having told them? Well, I think I probably do.”

Then why would you still call it rape?  Age is just a number right?  Where is all your outrage here?

But there is not any here, because it’s Hollyweird, and she is somewhat famous because of her skillset as an actor/singer, so it’s okay.  Condemn it in all areas…

But, back to Willow.  The best argument that they have is that for Willow to get knocked up, she would have to fall victim to “statutory rape.”  To actually figure that out, lets turn to Sandra Norman-Eady,  Christopher Reinhart and Peter Martino for some answers

Most states do not refer specifically to statutory rape; instead they use designations such as sexual assault and sexual abuse to identify prohibited activity. Regardless of the designation, these crimes are based on the premise that until a person reaches a certain age, he is legally incapable of consenting to sexual intercourse. You might want to save your faux-outrage for women/men who are actually being violated and not just made fun of. For basic research, the authors continue to lay out what the law has in mind.

First-degree sexual abuse of a minor for someone age 16 or older to engage in sexual penetration with someone under age 13.

Second-degree sexual abuse of a minor for someone age 16 or older to engage in sexual penetration with someone who is age 13, 14, or 15 and at least three years younger than the offender.

Fourth-degree sexual abuse of a minor for someone under age 16 to engage in sexual penetration with someone under age 13 and at least three years younger.

So, your best argument is that he made (allegedly) a joke that IF IT ACTUALLY HAPPENED, would be considered a sexual assault.   Which is flimsy.  I found the end of the Chicago Trib article interesting, in that it made a point that rings true…

But instead of apologizing — and he didn’t Thursday, either — he labeled them two of many bad jokes told over the years for “cheap laughs.”

That’s no excuse for careless wording and thinking, especially when minors are involved. Calling any teenager in the public eye promiscuous is, indeed, ugly.

And while Palin trying to play the incident to political advantage, casting it as, yawn, Hollywood vs. America, isn’t exactly pretty, she has every right to press her advantage until Letterman says the magic words: I’m sorry. (emphasis mine)

With all the competent women he could have chosen, he picked a fly by night governor of one of our smallest states, who’d only served a year and a half and yet was expected to inspire confidence she might lead the free world.Okay, enough said. That’s the recap. The election’s over. However, there are still conservative — make that right wing — diehards who’d love Palin to bring about resurgence to the Republican Party. In their dreams they believe she should be president. And while some might remind me similar jokes were made about Ronald Reagan’s chances for the White House, at least he was a two-term governor of our largest state and before that had built a nationally prominent nice-guy reputation as a popular actor in movies and television.

Sarah Palin is a lightweight, desperate not to fade away, as happened to Dan Quayle, and he was actually an elected vice president. And with her audience generally limited to fringe groups, she recently seized upon some silly patter on a late night talk show, and with the Media’s help has turned it into a cause celebre.

EXACTLY!  Don’t fade away, just continue to govern your state.  Get some practical experience and run your race in 2012.  You hamming it up for the cameras and attempting to make a campaign issue is not going to work.  And the calls for Letterman to be fired?  Only in your dreams, where Hillary Clinton won the election.

I think that most sensible people bought it, since you really can’t measure intent, and I am glad that he didn’t apologize, just clarified what his statements were about.  What people forget is that Dave Letterman would have to know which daughter attended the game with her.  I think the “knocked up” part was lost on people trying to condemn him for joking about a serious issue in rape.  Too bad your straw man fell the fuck hell apart.  The HuffPo continues…

So, what’s the beef? Earlier this week, Letterman had a dumb joke about Palin in his top ten list: “Bought makeup at Bloomingdale’s to update her slutty flight attendant look.” I wasn’t offended. It just wasn’t that incredibly funny. What was intriguing was Palin didn’t take note of another joke, which had her involved with a kilo of crack.

So, why does the author of the HuffPo get it, but others can’t?

Palin sensed an opportunity and accused Letterman of promoting date rape of her fourteen-year-old daughter Willow. As it turned out, she was the daughter who attended the game with her parents, but there’s not a doubt in my mind that most of the viewers watching the show reacted to the joke with the vivid image of Palin’s older daughter Bristol, who had gotten “knocked up” by her high school sweetheart.

The author gives her two barrels (and the rest of the media) for pushing a meme that is a flat out lie.

Sarah Palin is simply a Media hog, hypocritical and ruthless as it gets. Was it a coincidence that it was only after the campaign ended that Levi Johnston was summarily banished, no longer needed and later decried by Palin and her husband for cashing in on the family name. As if they hadn’t used him as well?

Reprehensibly, the Media lapped all this up and went about it as if they were chasing an ambulance. Many replayed Palin’s accusations or interviewed her, and she repeated what was now a lie — because she knew better — that Letterman had somehow violated her daughter. And worse, many of the Media journalists didn’t follow up her comments with the fact that Letterman insisted he was talking about Bristol.

3) Hypocrisy

Here is what I continue to not get about groups like PUMAS. They sit and complain about things when it suits them, but they are not consistent about them.  My1/2IQ makes a rash of sexist statements, then apologizes for them and we are supposed to forget them.  Jon Favreau makes a gesture THAT IS INTERPRETED as he is groping Hillary Clinton at a party.  he makes an apology, the SOS accepts it, but he is forever known as a sexist in the eyes of PUMAS everywhere.  Why doesn’t it work both ways?  Convenience is the only answer.

She further described David Letterman as a “so-called” comedian, a description that might better be associated with her political future. She also referred to him as a 62-year-old to somehow make the comment appear smarmier, as if he were an old lecher flashing young girls at the local middle school.

Exactly.  Either words have power and can hurt ( classic hate speech rhetoric and theory) or they don’t.  Her use of his age was calculated to draw a highlight between the disparity in ages of her daughters and the comedian.  To make it seems like Letterman is the new Chester the Molester.

This, too, was disgusting on her part, because it was ageist and uncalled for. Would the joke have been less offensive if Letterman were 35 or 40?

Then the biggest point of her hypocrisy is that she turned down his offer to appear on the show and discuss the comment.  This is the first time I have ever seen her turn down a chance to promote herself.  This site has video of her at the I Kill a Dog races with her husband, but the Tonight Show, with a bigger audience, she turned down.  Did she forget youtube and SNL?

She then refused his offer to have her come on his show saying that she didn’t want to help his ratings. This, from a woman who has been gallivanting around the broadcast Media with her false depiction of Letterman, an American treasure. A woman who appeared on Saturday Night Live last fall, a show in which Tina Fey frequently made Palin appear like an idiot, in a desperate attempt to appear cool and bolster the doomed campaign of her and her running mate.

Sarah, you want some coverage, Too Old will happily grant your desires…

As you know, my boy E sometimes has to work the graveyard shift.  So, when I am getting ready to leave, he is just getting back from the all night grind.  Last night was particularly brutal, as he worked from 6pm to 6am.  With that type of schedule coupled with the fact that it rotates between grave and normal day shift, you can see why his body would be going crazy.

So, as I ran into him this morning, we were talking about what he was doing to stay awake.  E lamented the fact that he was feeling wiped out about 4am, so he drank a Mountain Dew to help fight off sleep.  Normally, this would be a 5 hour energy drink, but he thought that he could beat off the rush of Dew faster, helping him go to sleep sooner when he got home.  Well E, don’t drink Red Bull Cola if you are trying to get to bed.

Germany is considering a nationwide ban on the high-energy drink Red Bull Cola after traces of cocaine were found in it.

Authorities in the states of Hesse and North-Rhine Westphalia have ordered retailers to stop selling the beverage – which is available in the UK.

The consumer ministries in the two states confirmed they had ordered retailers to pull the drink off their shelves after a food safety institute in North-Rhine Westphalia found the drug in samples.

Giant German retail group Rewe had already issued orders to remove the fizzy drink from its shops. Wilhelm Deitermann, spokesman for the North-Rhine Westphalia consumer ministry said he expected most – if not all – other German states to follow suit and ban the drink.

Red Bull Cola has protested the action. ‘De-cocainized extract of coca leaf is used worldwide in foods as a natural flavouring,’ said a spokesman.

The company added that Red Bull Cola as well as other food that contains coca leaf extract is considered safe in the EU as well as in the US.

I knew something was up with this drink.  We had a bunch of promo Red Bull Colas and one of my debaters started drinking one, and he kept coming back for more, like he was a crackhead!  I knew something had to be in that drink.

This is the reason that I do not complain about the food or service inside the restaurant or to the wait staff.

There is a rare occasion that I would complain about the food.  I went to Alioto’s in San Francisco, at Fisherman’s Wharf.

The place has a long history and it caters to seafood, being on the wharf.  I am one of those types that attempt to have the special of the place that I go to.  Just like I am not having the chicken at Harris

(because it’s a steak house in SF that is one that I go to when I am looking to be catered and want a good cut of meat) I am not going to Alioto’s to have steak.

So, when I looked at the menu, I decided to have a swing at the seafood pot pie, since it seemed homey and comfort style food.

I dug in and started to enjoy the various tastes in the pot pie.  About halfway through the pot pie, I discovered a fish bone in the pot pie.  Fish has bones obviously, but they shouldn’t appear in my pot pie.  I continued un-detoured and the next bite, there was another bone.  After attempting one more bite and and coming up with another bone, I finally complained to the waiter.  Before I could get to the waiter, the hostess stepped in.  I told her of the complaint and that I was done with this and she should go talk with the sous chef about it.  She tried to assuage my complaint by informing me that  fish have bones…

I kept my composure and remembered the recent Food Network shows.  I calmly told her that the person in charge of doing the fillet was not very skilled if I was coming up with that many bones.  She finally walked away.  I felt the need to say what I said, especially since I was not having any other course that could be tampered with.

The bottom line was that she was attempting to be flippant, but the meal was free, so I got mine…this woman was not so lucky

Yakeisha Ward, 29, is charged with assault and battery with intent to kill.

You had to be ready to get into some funk.  You thought that because she was at work, that she wouldn’t “keep it real”..

Clarendon County Sheriff Randy Garrett says the altercation continued outside where he says Ward got a gun from her car and a gun magazine from her trunk.

“It’s poor judgment on her part trying to settle this matter with a weapon. either way she had time to think about what she was doing when she was walking to her car,” says Garrett.

Investigators say Ward’s gun discharged during the altercation. They say a bullet fragment struck Samuel in the arm.

“Deputies were close by when they rolled up in the parking lot the victim and the suspect were still engaged in a fight,” says Garrett.

Before it ended, authorities say Ward struck the victim in the head with the gun.

YES. YES. YES. And get this it doesn’t matter what race (for lack of a more correct term) you are, or what political party you belong.

Reading the News today I came across the AP headline “Whites Lift McCain to Slim Lead Over Obama in Poll”. Of course I had to read. Mainly because it immediately sounded racist to me. I’ll let you read as well…

WASHINGTON – An overwhelming advantage in experience and lopsided support from working-class and suburban whites have lifted Republican John McCain to a slender lead over Barack Obama less than two months from Election Day, a poll on the presidential race said Friday.

The Arizona senator has a 13-percentage-point lead over his Democratic rival both with men and senior citizens, and a 23-point advantage among rural residents, according to the Associated Press-GfK Poll of likely voters. He’s also doing better than Obama at consolidating support from party loyalists: 94 percent of Republicans back McCain, while 83 percent of Democrats prefer the Illinois senator.

Obama has good news, too. He’s preferred two-to-one by those who say the nation’s economy is in poor shape — a strong position on an issue many surveys say is the public’s top worry. He also has an 18-point advantage among voters who look more to a candidate’s values and views than experience, and his weak showing with whites is generally no worse than Democrat John Kerry did in his losing but close 2004 race against President Bush.

The poll is in line with others showing that in the days since both parties picked vice presidential candidates and held their conventions, Republicans have gained momentum and erased a modest lead Obama held most of the summer. McCain leads Obama among likely voters, 48 percent to 44 percent, according to the AP-GfK Poll.

“My heart sort of runs with McCain and my mind probably tends to run toward Obama,” said David Scorup, 58, a county government official in Othello, Wash. “I think I resonate more with McCain.”

The poll suggests that perceived inexperience is more of a problem at the top of the Democratic ticket than in the No. 2 spot for Republicans.

Eighty percent say McCain, with nearly three decades in Congress, has the right experience to be president. Just 46 percent say Obama, now in his fourth year in the Senate, is experienced enough.

Fully 47 percent say Obama lacks the proper experience — an even worse reading than the 36 percent who had the same criticism about McCain running mate Sarah Palin, serving her second year as Alaska governor after being a small-town mayor.

“This is his fourth year in the Senate, and two of those four years he spent campaigning for president,” said Arthur Koch, 63, an undecided voter from Wallington, N.J. “I’m not too comfortable with that.”

Underscoring how tight the race remains, several swing groups that traditionally help decide presidential races remain split between the two tickets. These include independents, married women and Catholics.

Seven in 10 said Palin made the right decision in becoming McCain’s running mate, despite the demands of a family whose five children include a pregnant, unmarried teenage daughter and an infant with Down syndrome. Men were slightly likelier than women to back her choice, and even Obama supporters were split closely over whether she did the proper thing.

“She scares the bedoodles out of me,” said Lisa Rolfe, 46, an Obama backer and pharmaceutical worker in Pembroke Pines, Fla. But as for Palin’s choice, she said, “I know it’s going to be very difficult, but I’m sure she weighed her decision. That’s a very personal value.”

McCain leads Obama by 55 percent to 37 percent among whites. That includes margins of 24 points with suburban whites and 26 points with whites who haven’t finished college, plus similar advantages with white men and married whites.

The poll finds that despite Democratic attempts to tie McCain to the profoundly unpopular Bush, half say they believe the Arizonan would chart a different course — including a slight majority of independents, a pivotal bloc of voters. In addition, although slightly more call themselves Democrats than Republicans, conservatives have a huge 40 percent to 20 percent edge over liberals.

Ken Campbell, 49, a Republican and county sheriff in Lebanon, Ind., said of Obama: “Our lifestyles and beliefs are so radically different that there is no similarity whatsoever.”

Obama leads 61 percent to 35 percent among voters under age 30. He has about a 5-to-1 edge with minorities and narrow advantages with college graduates and women, though he trails among white women 53 percent to 40 percent.

Asked if they prefer a presidential candidate with solid experience or one whose values and views they support, two-thirds picked the latter. While those preferring experience overwhelmingly back McCain, people opting for a contender’s values say they’ll back Obama over McCain, 56 percent to 38 percent.

“Obama seems to be more oriented toward getting people together,” said Ron Long, 60, of Pella, Iowa, an Obama supporter.

Though Obama led among those who said values were more important than experience, respondents gave a 9-point edge to McCain as the candidate whose values and principles are similar to theirs. He had an 8-point edge over whom people agreed with on issues.

In another sign of recent GOP gains, people said they preferred a Democratic to a Republican-run Congress, 46 percent to 41 percent. Several surveys earlier this year gave Democrats a wider edge.

The AP-GfK Poll was conducted Sept. 5-10 and involved landline and cell phone interviews with 1,217 adults, including 812 considered likely voters. The margin of sampling error was plus or minus 2.8 percentage points for the entire sample and 3.4 points for likely voters.

O.K. The article is suspect at best. And I really don’t believe the #’s. (and not just the one’s that favor McCain but ALL of them) And for various reasons that have been discussed by many far more intelligent people than myself. Such as degree of “likely voters” or “geographic limits” or my favorite “decline of landline use” and lets not forget the granddaddy of them all the “refusal rate” which if too high and normally is cancels everything. All this is interesting b/c these issues still have not been addressed by the poll takers. Interesting??? Have they given up on accurate polls? The accuracy question became more apparent after reading the Editor’s Note. Why spend so much space discussing the supposed “partnership” of pollsters and the years of experience each has if data is accurate? Plus why go German? What do they know about American voters? Also 1930??? Did they also help Hitler in his poll taking? Anyway, I digress.

The point is the headline makes me think someone had an agenda to shake things up with such a racist headline. Oh, BTW its racist b/c why pick one # to establish the defining momentum of the overall poll and or the eventual vote? In business we call this a “pick-n-play”. Pick one thing you like or don’t like about a company and put that issue in play. e.g. the iPod’s cool new features appeal to 90% teens means Apple will post better than expected earnings next Qtr. See. Just doesn’t work like that. Although it is how the business world works.

So what was the agenda? I don’t know? And we maybe will never? But the interesting fact I discovered with a little research was that both Obama and McCain supporters felt the headline was RACIST. Wow. B/c this wasn’t readily apparent tto me. I mean, I felt it was racist as an Obama supporter b/c why draw attention to the racial (FLOABW) division which seemed to have the intention to UNITE whites. Or some sort of hey Whitey follow the trend and reunite with your brethren by voting McCain.

But get this…Those allying with McCain thought the headline was also racist. Or at least those commenting at Republican websites like the FreeRepublic.com or Lucianne.com. I was surprised. Their point or “parant” (as another racist Archie Bunker would say) was that the headline made McCain supporters appear to only vote for his wife-beating ASS only b/c he is white. Where as Obama or Barry (as they call him, which I don’t really get) has a 5-to-1 edge with minorities. Thus Blacks are the real racist.

Interesting…And maybe even valid for a few people I’ve never met.
